Important: This document is a plain‑language re‑write of CSCONSEIL’s Terms of Service. It does not constitute legal advice. You should have a qualified lawyer review the final draft before you publish it.

These Terms govern the relationship between CSCONSEIL ("CSCONSEIL", "we", "us") and any natural or legal person that registers to use the online services available at https://datamonkeyz.com/ (the "Platform"), hereafter the "User" or "you". CSCONSEIL and the User are each a "Party" and together the "Parties".

If you are a company that allows employees, agents or subcontractors (collectively "Authorised Users") to access the Platform, you must make these Terms known to them and ensure they comply with them. You remain liable for any breach by Authorised Users.

By creating an account you confirm that you have read, understood and unconditionally accepted these Terms.


2. Definitions

"Crawler"Any automated or semi‑automated software agent supplied by CSCONSEIL through the Platform to interact with third‑party servers.
"Store"The digital marketplace operated by CSCONSEIL where Crawlers are listed.
"Force Majeure"An event beyond a Party’s control that could not reasonably be foreseen or avoided (e.g. war, terrorism, natural disaster, epidemic, large‑scale network outage).
"Intrusion Test"Any software or process (e.g. LoadRunner, JMeter) that simulates user activity for load or stress testing.
"Services"Hosting, execution and related features that allow Users to run Crawlers and manage the resulting data.
"User"A User who deploys Crawler from the Store.

3. Access to the Platform

3.1 Sign‑up

  • Fill in every required field of the registration form truthfully and completely.
  • The Platform is intended strictly for professional use; consumers are not permitted.
  • CSCONSEIL may deactivate any account that contains false, incomplete or misleading information, without notice or liability.
  • Users must have full legal capacity. Minors may not use the Services.
  • You log in with your email address and a password (or via a compatible third‑party SSO module). Choose a strong password and change it regularly.
  • Your credentials are personal. Any action taken under them is deemed to be yours. If you suspect compromise, reset your password immediately at https://app.datamonkeyz.com/auth/forgot-password.

3.2 Availability

  • You are responsible for the hardware, software and Internet connection needed to reach the Platform.
  • We aim for 24 / 7 availability but may suspend all or part of the Platform for maintenance, upgrades or other reasons, without compensation.
  • We may change the Platform’s features at any time.

4. Description of the Services

  1. Deploy & run Crawlers – Choose a Crawler from the Store and configure it to perform tasks on a target website.
  2. Data storage – Depending on your settings, data collected by a Crawler can be stored on our servers or on a third‑party server you specify. If the data is stored by us, you may export it once all invoices are paid.

The underlying infrastructure is operated by CSCONSEIL and may be shared with other Users.


5. Pricing & Payment

  • Subscription plans and prices are listed at https://datamonkeyz/pricing.
  • Free plans may impose limits (e.g. data volume, export options) as stated on the pricing page.
  • Subscriptions run for a fixed period (the "Initial Term") and renew automatically for the same duration unless cancelled in line with section 12.
  • Fees are billed monthly in arrears, in € or $ depending on your location. Prices include applicable taxes.
  • Payments are processed by Stripe (PCI DSS level 1). You must be authorised to use the chosen payment method. We may suspend the Services for any payment failure.

6. Obligations

6.1 User duties

You must:

  1. Obtain any permission required to access target websites via a Crawler.
  2. Avoid extracting a substantial part of a database.
  3. Respect all third‑party intellectual‑property and confidential‑information rights.
  4. Comply with applicable laws, including data‑protection rules.

CSCONSEIL does not monitor Crawler activity in advance and accepts no liability for misuse.

6.2 General User duties

Without our prior written consent you may not:

  • Post or transmit unlawful, threatening, defamatory, obscene or discriminatory content via the Platform.
  • Interfere with the Platform’s performance or with other Users.
  • Upload viruses, malware or any harmful code.

Unauthorised access to or sabotage of an information system is a criminal offence under Articles 323‑1 ff. of the French Penal Code (up to 5 years’ imprisonment and a €150 000 fine).

We may suspend or terminate accounts that breach these rules and you will indemnify us for any resulting loss.


7. Licence to Use the Platform

We grant you a worldwide, non‑exclusive, non‑transferable, non‑sublicensable right to use the Platform for the duration of your active account.

You must not (and must prevent anyone else from): reverse‑engineer, decompile, disassemble or otherwise attempt to derive the source code; remove proprietary notices; integrate the Platform into other software; or use it in any way not expressly allowed by these Terms. French intellectual‑property law (Article L.122‑6‑1) applies.


8. Personal Data

Our Personal Data Agreement explains how we handle personal data. It is available at https://datamonkeyz.com/personal-data-agreement.


9. Intellectual Property

The Platform, the Crawlers and all content provided by CSCONSEIL (unless uploaded by the User) remain our exclusive property or that of our licensors. No rights are transferred to you except the limited licence in section 7.


Links to external sites or content are provided for convenience. We do not control or endorse them and are not responsible for their accuracy or legality. You access third‑party sites at your own risk and their own terms apply.


11. Warranty & Liability

The Platform is supplied as is and as available. We give no warranty of uninterrupted or error‑free operation.

To the fullest extent allowed by law, our total liability for all claims in any rolling six‑month period is capped at the fees you actually paid during that period. Any claim must be brought within one (1) year of the event giving rise to it.


12. Termination

You may close your account at any time via the Platform or by emailing simon.rochwerg.pro@gmail.com. Termination takes effect at the end of the current subscription term.

We may suspend or terminate your account immediately (i) for breach of these Terms or of public‑order rules, (ii) for infringement of intellectual‑property rights, (iii) for suspected fraud or credential compromise, or (iv) if required by law or court order.

Upon termination you must stop using the Platform. We will have no liability for any resulting loss.


13. Miscellaneous

  • Intrusion tests – You may run automated scripts that do not create accounts and do not qualify as Intrusion Tests. Any Intrusion Test requires our prior written approval. You will be liable for any damage it causes.
  • Reporting illegal content – Notify us of unlawful content via the in‑platform reporting tool or by email.
  • Changes to the Terms – We may update these Terms at any time by posting a new version. If you disagree, you may terminate your subscription.
  • Force Majeure – Neither Party is liable for delay or failure caused by a Force Majeure event.
  • No waiver – Failure to enforce a right is not a waiver of that right.
  • Severability – If any clause is invalid, the remainder of the Terms stays in effect.
  • Electronic evidence – Our electronic records are admissible as proof of transactions and communications.
  • Relationship of the Parties – The Parties are independent contractors; nothing here creates an agency, joint venture or partnership.

14. Governing Law & Jurisdiction

These Terms are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Paris.
